There having been a disclosure of an Impartiality Interest, Cr Dewan believes there is a good reason having regard to the Drain case and the IW case referred to above, for the Council Member having disclosed the Impartiality Interest to be in a position where they are not present in the chamber when the issue of rezoning comes up for consideration and voting.
Cr Dewan has made a lawful disclosure of Impartiality Interest.
Cr Dewan received a legal opinion from the Executive on 7 December 2021.
In view of the opinion received, Cr Dewan has taken a considered view, to minimise any risk for the Council and abide by it and stay out of Chambers when Item 13.1 commences. |
