Graffiti along freight rail line in Yangebup

The City of Cockburn's response to Cockburn Gazette, 23 April 2021 about graffiti along the freight rail line in Yanbegup -


Question: Has the City had any complaints about the aforementioned graffiti? Have there been any requests for it to be cleaned?

Answer:
The City receives many complaints which are forwarded to Arc Infrastructure as it has ownership, control and management obligations of the rail corridor. The City cannot take ownership of those complaints or remedy them because access must be sought through a third party agreement contract. This agreement contract can take months to finalise. For example, the last time the City applied, it took 6 months to finalise for works that took just one hour to complete.

Question: Can you confirm ARC Infrastructure is responsible for the land alongside the railway which runs underneath Spearwood Avenue?

Answer: Yes.

Question: As land owner, does it fall to ARC to ensure the area is kept tidy and graffiti kept to a minimum? Or is it considered a City of Cockburn issue?

Answer: It is not the City’s responsibility to undertake remediation for graffiti issues on third party land. Any questions around responsibility for removal of graffiti on Arc Infrastructure land and assets are best directed to Arc Infrastructure.

Question: Has the City of Cockburn contacted ARC offering to clean up the area at all?

Answer: The City refers complaints to Arc Infrastructure.

Question: Is the City able to access that area at all?

Answer: 
Not without a third party agreement contract that can take many months to approve.

Answer: The City does not take action on land under the management responsibility of other agencies.

Question: Are there any hindrances preventing the cleaning up of the graffiti along the back of people’s fences or cleaning up the rubbish in the area between the fences and the train tracks?

Answer: This question is best directed to Arc Infrastructure. Access to Arc Infrastructure land by a third party is only feasible via an agreement contract which can take months to be approved.

Question: Do you know when the last time the area was tidied up and graffiti cleaned?

Answer: No.
