If you were not the driver of the vehicle at the time the infringement was issued, you have 28 days to nominate the actual driver by completing a Statutory Declaration with the drivers full name and current address and forwarding it to the City of Cockburn, PO Box 1215 Bibra Lake DC WA 6965.
In the absence of proof to the contrary you will be deemed to have committed the offence (owner onus) and therefore liable for the payment of the infringement.
If you choose not to pay an infringement, the matter will be referred to the Fines Enforcement Registry.
This will incur additional costs and you may have your drivers licence suspended under the Fine Enforcement legislation.
Should you wish to have an infringement to be dealt with by a Court rather than investigated by the City, you must notify the City in writing. On receipt of such a notification, the City will make all necessary arrangements for the matter to be heard in Court and will issue the appropriate summons indicating the date on which you are to appear in Court.
You have the opportunity to plead Guilty on the summons and the matter will be heard without you having to attend Court.
You have the option of seeking legal advice, engaging a lawyer or representing yourself.
